It's important to note that we are not a travel agent, and as such, we are not responsible for establishing, setting, or controlling the prices associated with any of the travel options or products you discover and book through our Services.

Additionally, it enables you to make bookings for flight tickets, hotels, train tickets, car rentals, airport transfers, and attraction tickets (referred to as "Travel Products") offered by third-party suppliers ("Suppliers"). Depending on your location, Travel Products may encompass ferry and bus tickets, tours, cruises, and trips as well. We also extend customer support services for bookings conducted through our website. These terms specifically pertain to these booking services.

When you make a booking for a Travel Product, it's essential to acknowledge that your booking is bound by the terms and conditions of the respective Supplier (such as the airline or hotel). It's crucial to thoroughly review these terms as they establish a separate legal agreement between you and the relevant Supplier. 

 

Various terms and conditions, including cancellation and change rights, vary across different Travel Products. These will be presented to you during the booking process and are integral to these terms. It's imperative to carefully review them before finalizing your booking. 

 

Furthermore, these terms outline the regulations for utilizing our website, encompassing content standards applicable when uploading content, linking to our website, or engaging with it in any other manner. 

 

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by these Legal Terms. • Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords 

• Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein  

• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services 

• Use any information obtained from the Services to harass, abuse or harm another person 

• Make improper use of our support services or submit false reports of abuse or misconduct 

• Use the Services in a manner inconsistent with any applicable laws or regulations 

• Engage in unauthorized framing of or linking to the Services 

• Upload or transmit (or attempt to upload or to transmit) viruses, trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features functions, operation, or maintenance of the Services 

• Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools

• Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ("gifs"), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms or “pcms"). 

• Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services 

• Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you 

• Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services 

• Copy or adapt the Services software, including Flash, PHP, HTML, JavaScript, or other code. 

• Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or making up a part of the Services. 

• Except as may be the result of standard search engine or internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or use or launch any unauthorized script or other software 

• Use a buying agent or purchasing agent to make purchases on the Services 

• Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means to send unsolicited emails, or create user accounts by automated means or under pretenses 

• Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavour or commercial enterprise.

Redirection and Third-Party Booking Services

Should you be directed from our Service to a third-party booking service (like for car rental) to make a travel reservation, please note that any bookings completed through such a service will be with the third party, not us. We hold no responsibility for bookings made via third-party booking services, and we bear no liability to you concerning such bookings. The terms and conditions of the third-party service provider will outline your rights against them and clarify their liability to you.

6. Applicable Law and Place of Jurisdiction

The law of India governs these terms and any dispute or claim (including non-contractual disputes or claims) arising out of them, their subject matter or formation. However, you are not deprived of any mandatory consumer rights of the law of the country in which you are resident. Therefore, You and We both agree that the Courts of India will have jurisdiction over any dispute or claim arising out of these terms.

7. Liability

 

7.1. AirX disclaims responsibility for the precision, quality, entirety, dependability, or credibility of content provided by users and/or booking sites. Notably, AirX does not offer advice or information concerning accommodation selection. 

 

7.2. All agreements resulting from this service occur between the AirX user and the respective external contracting booking site. AirX does not function as an organizer or travel agency at any point. The terms and conditions of the respective organizer or travel agency are exclusively applicable, especially concerning cancellation and withdrawal rights. The contact for booking and payment processing, as well as contractual inquiries, is the respective contracting booking site. AirX remains uninvolved in such contractual arrangements, agreements, and claims between the AirX user and the respective external contracting booking site.  

 

7.3. AirX does not authenticate the accuracy of content uploaded by booking sites or Community members. This content, provided by booking sites/Communities for publication on our website concerning the respective hotel, is beyond AirX’s control (including images, comments, reviews, etc.). The publication of user-generated content and reports on AirX does not reflect Airx’s opinion, specifically disclaiming ownership of such content. 

 

7.4. Particularly, hyperlinks, advertising banners, information about accommodations, travel destinations, or providers, etc., are supplied by booking sites and Community members and do not represent recommendations or information from AirX. Due to technical constraints, real-time updates of prices received from booking sites are not guaranteed. Therefore, the price displayed on the booking site may differ from that specified on AirX sites. AirX does not guarantee accuracy of information, especially regarding prices and availability.  

 

7.5. AirX is not liable for technical malfunctions outside its responsibility or damages caused by force majeure. Continuous data availability is not guaranteed, and technical maintenance may occur during a chosen timeframe.

8. Indemnification

By accepting these terms, you agree to defend and indemnify AirX and our Partners, as well as any of their officers, directors, employees, and agents, from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs or expenses ("Losses") brought by third parties. These Losses may include but are not limited to, reasonable legal and accounting fees. They may arise due to: 

• Your violation of these Terms or the documents referenced within them 

• Your infringement upon any law or the rights of a third party 

• Your utilization of our Service 

This indemnification applies to the extent that such Losses are not directly caused by the actions of AirX or our Partners.
